Terms and Conditions

By placing an order on moonbears.it, the customer confirms that they have read, understood and accepted these Terms and Conditions.

In this document, “we” refers to Silvia Ferioli, the owner of moonbears.it.

1. Safety and intended use

The stuffed animals made by moonbears.it are decorative items and are not intended for use as toys.
They are not suitable for play or for children under 14 years of age.

2. Materials and responsibility

All products are made using materials supplied by the customer.
As we cannot verify their origin or composition, we cannot certify the stuffed animals as compliant with CE requirements.
They are therefore not suitable for children under 14 years of age.

3. Condition of the clothing supplied

Clothing supplied by the customer must be:

• cleaned before shipping

• in good condition and suitable for crafting

Damaged, dirty or excessively worn fabrics may affect the quality of the finished product.

4. Product care

The stuffed animals are made from fabrics that have already undergone various treatments. We recommend handling the finished product with care to preserve its quality over time.

5. Safety eyes

Although the eyes used are CE-certified, they are not safe for children under 5 years of age.

6. Personalisation and fabric scraps

You may specify any preferences regarding the use of your clothing in the order form. If no preferences are provided, the design will be left to our workshop's artistic discretion.
If you would like your fabric scraps returned, please specify this in the order form. Otherwise, only unused garments will be returned.

7. Use of fabric scraps

If the customer does not request the return of fabric scraps, they authorise moonbears.it to reuse them for:

• creating products for charitable purposes

• making handcrafted items in keeping with circular economy principles

Some of the sewing patterns used to make our products are licensed by:

• Funky Friends Factory

• Xanthe Patterns

9. Prices, payment and invoicing

All prices are stated in euros. VAT is not charged, as the business operates under the Italian flat-rate tax scheme (Article 1, paragraphs 54–89, Law No. 190/2014).
Accepted payment methods are:

• PayPal

• Credit/debit card

• Bank transfer

• PostePay top-up

An electronic invoice is issued only upon request, which must be made when placing the order.

10. Production and shipping times

Your product will be made during the month corresponding to your booked production slot.
The customer will be informed of the estimated timeframe at the time of purchase.
Products are shipped by courier to the address provided by the customer.
moonbears.it is not responsible for delays attributable to the courier.
Shipping costs are displayed before payment and on the website's homepage.

11. Right of withdrawal

Under Article 59 of the Italian Consumer Code, the right of withdrawal does not apply to personalised or made-to-order products.
All moonbears.it products are handcrafted using materials supplied by the customer. Orders therefore cannot be cancelled or returned once confirmed.

13. Jurisdiction

In the event of a dispute, jurisdiction lies with the court for the consumer's place of residence or domicile, as provided by Article 66-bis of the Italian Consumer Code.

14. Changes to these Terms

We reserve the right to amend these Terms and Conditions at any time without prior notice. Changes will take effect from the date they are published on moonbears.it.
